Tanzanian Ferry Accident Kills 146

An overloaded ferry in Tanzania flipped over and sank killing 146 people on Wednesday. Rescue efforts were halted today as rescuers were unable to locate the sunken boat and felt there was little hope of locating additional survivors. Rescue efforts were hindered by high winds and strong underwater currents. The boat was thought to have sunk in 75 feet of water but likely got carried further out to sea by the currents in which it sank.

Authorities in Tanzania said the ferry was leaving the port townof Dar es Sallam and heading to the island of Zanzibar. The boat was carring 291 passengers although it was only certified to carry 250. this is against the law. When a negligent act occurs and the negligence is also a violation of the law, this is not only actionable but the illegal act gives the injured party a presumption under the law that the negligent actor was wrong.

The cause of the tragedy is still unknown and of the 146 people thought dead, 77 are still "missing" and not able to be located after three days of searching.

A similar tragedy happened last year when a ferry carring over 200 people sank while traveling between the islands of Zanzibar.
