What to do After You Are Injured in an Auto Accident?

People call my office all the time to tell me they were just in acar accident. I usually say that I am very sorry to hear that and ask if they were hurt. Often times the answer is "no", in which case there is nothing more that I can do for the person. My favorite answer is, "not really", which is usually followed up with something like, "Should I be?" or "Can I make money?" I normally great these comments with a laugh and wish the caller the best of luck.

The first thing I will normally ask is whether or not you have been to a doctor. Did you go to the emergency room? Was it by ambulance? Did you go to an urgent care facility on your own? Do you have medical insurance? Do you need a referral to a doctor who will treat you on a "lien basis"? This means a doctor that will wait until your case settles to get paid.

Next we try to assess how serious the injury actually is. We wouldn't send you to a chiropractor if you have broken bone. We might want to send you to a specialist, like an orthopedist, to see if you need surgery or other treatment for serious injuries. After the major injuries are healed then we can talk about additional therapy from a physical therapist, chiropractor or even some forms of alternative medicine like acupuncture.

At the same time that your medical treatment is going on, my staff and I are working with the insurance companies toward getting your property repaired or replaced and getting you a rental car if needed. Once your car is fixed and any other property damage is repaired, you can get back on the road to healing even easier.

Eventually, your medical treatment will come to a close and we will do our best to settle your injury claim in a fair and equitable manner. We then work with the medical providers in settling their bills, often at a substantial reduction. If you were the victim of a crime, like a DUI causing injuries, we might be able to get the court to order the wrongdoer to pay restitution for your medical bill or other out of pocket expenses.

Finally, after the dust settles, after all the medical bills are paid and you are put back into the position you were in before the accident, there is often a large monetary settlement for your pain and suffering. That's right, you can get your medical bills paid, car fixed, rental bill paid and walk away with some cash in your pocket when it is all over.

Before I go I would like to leave you all with some parting thoughts: Don't talk to anyone except your lawyer about your claim. Of particular importance is that you do not talk to the other insurance company about the accident without your lawyer's o.k. People often speak to the other insurance company before they talk to their lawyer. When asked if they were hurt, an answer like, "Not really", can devastate a personal injury case.
