motorcycle officer was injured in Sun Valley yesterday after his motorcycle was rear-ended by an unknown
man driving a red SUV. The police officer was stopped at a red light when
the other driver crashed into the back of the police motorcycle causing
the officer to become pinned between two cars. The officer was rushed
to a local hospital and described to be in critical condition from his injuries.
The driver was later arrested for driving under the influence of alcohol
and possession of narcotics. The driver is in custody pending posting
bail of $100,000. He will likely go to court on Tuesday for his arraignment.
DUI collisions are often excellent cases for personal injury lawyers for several reasons.
First, when the wrongdoer is under the influence of alcohol, this means
that the claim may warrant an award of punitive damages, or damages above
and beyond those for normal pain and suffering and intended to punish
the wrongdoer. An award or even the threat of an award of pain and suffering
will often be enough to leverage a very favorable settlement with an insurance
company even without the need to file a lawsuit.
Next, when someone is injured while at work, that may give rise to a worker's
compensation claim. This may be instead of or in addition to a personal
injury claim. The injured party, with the help of their skilled attorney
can decide if the party should pursue one claim or the other or in some
cases both claims at the same time. Worker's compensation claims are
intended to compensate injured workers and get them paid for their injuries,
lost work, and even permanent settlements for workers who cannot go back
to work or cannot do the same work they used to perform. In some cases,
settlements will even pay for future medical needs, job training or schooling
and other expenses, as necessary.
