A drunk driver critically injured an 8 year old boy in Los Angeles earlier today. Police arived to the scene of a terrible traffic collision to find that a Cadillac Escalade center punched a Dodge Durango sending all three Durango occupants to the hospital, one with critical injuries. The 8 year old is expected to live and the driver of the Escalade was arrested for DUI.
The other to Durango occupants were the parents of the 8 year old. They were described as being in satifactory condition and their son is expected to survive.
DUI driving accidents are very dangerous cases. The law presumes that driving under the influence of alcohol is an inherently dangerous activity. As such, if a drunk driver kills another human they can actually be charged with murder and be sentenced to 15 years to life.
In civil court, the law seeks to punish DUI drivers who injure people. The means the court can award extra damages or money to punish the wrongdoer for his actions. These damages are called punitive damages and are often substantially more money than normal or compensatory damages which might be assessed in a "normal" car accident.
